Prof. Higashinakano Lost the Defamation Case in Supreme Court of JAPAN




It is a little bit old "news" because it was on February 5th; the first petty bench of the Supreme Court in Tokyo, Japan made the final decision about the defamation lawsuit case in which Japanese denier of Nanjing massacre was sued by a Chinese woman. Since this website has already written about the topic, I would like to write again the issue a little tonight.

Prof. Higashinakano of Ajia Daigaku (Asia University) is an infamous denier of Nanjing Massacre that happened on December 1937 in then-capital of Republic of China. In the massacre, Japanese Imperial Armies killed so many Chinese. There are so many testimonies about the massacre, and one of the most atrocious is what happened on Ms. Xià ShūQín(#1)'s family. Prof. Higashinakano wrote in his book that she was different person from one of survivors of the killings as if Ms. Xia Shuqin was a liar.

Ms. Xia appealed the lawsuit case in Japan, accusing him of defamation. He has already lost twice in the lower courts. The first decision even said that "His interpretation of written materials is not appropriate at all, having no value as a result of academic research(#2)". And on February 5th, the chief justice of the first branch Wakui Norio handed down the final judgment in the Supreme Court. The judgment turned down the appeal and confirmed the determined the lower court's decision that orders Prof. Higashinakano and publisher "Tendensha" to pay 4 million yen (40,000USD approx.).

Nonetheless, his books are widely supported by so many Japanese with many five stars on "amazon.co.jp". I don't think such people are majorities in Japan, but I worry that, even they are small fraction of Japanese, their persisting activities could bring a bad influence to the society. And I would like to point out one thing. The hawkish rightwing newspaper "Sankei" reports this court decision. Despite of estimation by the court that his writings are having no value as a result of academic research, the paper says "Compensation Determined, Nanjing Incident Research Book"(#3). Sankei still uses the word "research" for what is not regarded as research at all.

When was the last time that his voice appeared on the radio? Recentdays, the program has been substituted by other person.
